Stat. § 25:2-26","heading":"Factors in determining intent.","body":"Factors in determining intent.\nIn determining actual intent under paragraph (1) of subsection a. of R.S.25:2-25 consideration may be given, among other factors, to whether:\na.\tThe transfer or obligation was to an insider;\nb.\tThe debtor retained possession or control of the property transferred after the transfer;\nc.\tThe transfer or obligation was disclosed or concealed;\nd.\tBefore the transfer was made or obligation was incurred, the debtor had been sued or threatened with suit;\ne.\tThe transfer was of substantially all the debtor's assets;\nf.\tThe debtor absconded;\ng.\tThe debtor removed or concealed assets;\nh.\tThe value of the consideration received by the debtor was reasonably equivalent to the value of the asset transferred or the amount of the obligation incurred;\ni.\tThe debtor was insolvent or became insolvent shortly after the transfer was made or the obligation was incurred;\nj.\tThe transfer occurred shortly before or shortly after a substantial debt was incurred; and\nk.\tThe debtor transferred the essential assets of the business to a lienor who transferred the assets to an insider of the debtor.\namended 2021, c.92, s.7.","path":["TITLE 25 FRAUDS AND FRAUDULENT CONVEYANCES"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"8d15970b6b463535180a12f364024eb34137c7f41a51d7be95388ef7d0e8f66b","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-25-2-25","next":"us-nj/n.j.-stat.-25-2-27"},"notice":"GroundRules: Original legal text.
