Stat. § 26:2H-105","heading":"Execution, reaffirmation, modification, revocation, suspension of advance directive for","body":"mental health care.\n4.  a.  A declarant may execute, reaffirm, modify, revoke or suspend an advance directive for mental health care at any time, except as provided in subsection f. of section 5 of this act.\n(1)\tThe advance directive shall be signed and dated by, or at the direction of, the declarant in the presence of at least one subscribing adult witness, who shall attest that the declarant is of sound mind and free of duress and undue influence.\n(2)\tThe advance directive may be supplemented by a video or audio tape recording.\nb.\tThe following persons shall not act as a witness to the execution of an advance directive for mental health care:\n(1)\ta designated mental health care representative; and\n(2)\tthe responsible mental health care professional responsible for, or directly involved with, the patient's care at the time that the advance directive is executed.\nc.\tA person shall not act as a sole witness to the execution of an advance directive for mental health care if that person is:\n(1)\trelated to the declarant by blood, marriage or adoption, or is the declarant's domestic partner or otherwise shares the same home with the declarant;\n(2)\tentitled to any part of the declarant's estate by will or by operation of law at the time that the advance directive is executed; or\n(3)\tan operator, administrator or employee of a rooming or boarding house or a residential health care facility in which the declarant resides.\nL.2005,c.233,s.4.","path":["TITLE 26 HEALTH AND VITAL STATISTICS"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"4ed75c0cb9da15ce2f730a1074eed3dd0dd139a8539df45e3d56ecc4ef8dbb9b","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-26-2h-104","next":"us-nj/n.j.-stat.-26-2h-106"},"notice":"GroundRules: Original legal text.
