Except as provided in subsection b. of this section, assistant prosecutors shall devote their entire time to the duties of their office and shall not engage in the practice of law or other gainful employment.\nb.\tNotwithstanding the provisions of subsection a. of this section, an assistant prosecutor may engage in limited outside employment or provide services as an independent contractor, under such terms and conditions as the county prosecutor deems appropriate, if:\n(1)\tthe county prosecutor has deemed the employment or services as not inconsistent with the duties of the office of assistant prosecutor;\n(2)\tthe employment or services do not involve the private practice of law or the provision of other legal services; and\n(3)\tthe employment or services do not qualify the assistant prosecutor for membership in any State-administered pension system.\nc.\tNothing in subsection b. of this section shall be construed to:\n(1)\tlimit the discretion of the county prosecutor to disapprove a request from an assistant prosecutor to engage in employment or services or to require an assistant prosecutor to terminate employment or services otherwise authorized under this section; or\n(2)\tcreate an affirmative right for any assistant prosecutor to engage in employment or services without the approval of the county prosecutor.\nL.2009, c.285, s.3.","path":["TITLE 2A ADMINISTRATION OF CIVIL AND CRIMINAL JUSTICE"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"6f0b8b9c5b66f507b49c4bf37a4a02bc3f02f74f926948a5fa322a578d8f9591","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-2a-158-15","next":"us-nj/n.j.-stat.-2a-158-15.3"},"notice":"GroundRules: Original legal text.
