Stat. § 2A:4-30.187","heading":"Initiation by the State IV-D agency of support proceeding under convention.","body":"64.\tInitiation by the State IV-D Agency of support proceeding under Convention.\na.\tIn a support proceeding under this article, the State IV-D Agency or its designee shall:\n(1)\ttransmit and receive applications; and\n(2)\tinitiate or facilitate the institution of a proceeding regarding an application in a tribunal of this State.\nb.\tThe following support proceedings are available to an obligee under the Convention:\n(1)\trecognition or recognition and enforcement of a foreign support order;\n(2)\tenforcement of a support order issued or recognized in this State;\n(3)\testablishment of a support order if there is no existing order, including, if necessary, determination of parentage of a child;\n(4)\testablishment of a support order if recognition of a foreign support order is refused under paragraph (2), (4), or (9) of subsection b. of section 68 of this act;\n(5)\tmodification of a support order of a tribunal of this State; and\n(6)\tmodification of a support order of a tribunal of another state or a foreign country.\nc.\tThe following support proceedings are available under the Convention to an obligor against which there is an existing support order:\n(1)\trecognition of an order suspending or limiting enforcement of an existing support order of a tribunal of this State;\n(2)\tmodification of a support order of a tribunal of this State; and\n(3)\tmodification of a support order of a tribunal of another state or a foreign country.\nd.\tA tribunal of this State may not require security, bond, or deposit, however described, to guarantee the payment of costs and expenses in proceedings under the Convention.\nL.2016, c.1, s.64.","path":["TITLE 2A ADMINISTRATION OF CIVIL AND CRIMINAL JUSTICE"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"1bdc2bf7eb1767691a9c3e825c444b1fc5d4f01e275e0a40693ad5797767cea9","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-2a-4-30.186","next":"us-nj/n.j.-stat.-2a-4-30.188"},"notice":"GroundRules: Original legal text.
