A person shall not sell, or offer to sell, a novelty lighter.\nb.\tFor the purposes of this section, \"novelty lighter\" means a mechanical or electrical device typically used for lighting cigarettes, cigars, or pipes, that is designed to resemble any cartoon character, animal, musical instrument, toy, gun, watch, vehicle, food, or beverage or similar articles, or that plays musical notes, or has flashing lights, or has other entertaining features.\nA novelty lighter may operate on any fuel, including butane, isobutene, or liquid fuel.\nNothing in this section shall be construed to include the following in the definition of \"novelty lighter\":\n(1)\tany lighter manufactured prior to January 1, 1980;\n(2)\tany lighter incapable of being fueled or lacking a device necessary to produce combustion or a flame;\n(3)\tany mechanical or electrical device primarily used to ignite fuel for fireplaces or for charcoal or gas grills; or\n(4)\tstandard lighters that are printed or decorated with logos, labels, decals, or artwork, or heat shrinkable sleeves.\nL.2009, c.163, s.1.","path":["TITLE 2A ADMINISTRATION OF CIVIL AND CRIMINAL JUSTICE"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"2bcd24ae9d4921199c842aea0436f48356d77a7b6dc688763f527b0b8fc8b61a","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-2a-65b-3","next":"us-nj/n.j.-stat.-2a-65c-2"},"notice":"GroundRules: Original legal text.
