Stat. § 2C:34-6","heading":"Definitions","body":"2.\tAs used in sections 2 and 3 of this act:\na. \t\"Sexually oriented business\" means:\n(1) \tA commercial establishment which as one of its principal business purposes offers for sale, rental, or display any of the following:\nBooks, magazines, periodicals or other printed material, or photographs, films, motion pictures, video cassettes, slides or other visual representations which depict or describe a \"specified sexual activity\" or \"specified anatomical area\"; or still or motion picture machines, projectors or other image-producing devices which show images to one person per machine at any one time, and where the images so displayed are characterized by the depiction of a \"specified sexual activity\" or \"specified anatomical area\"; or instruments, devices, or paraphernalia which are designed for use in connection with a \"specified sexual activity\"; or\n(2) \tA commercial establishment which regularly features live performances characterized by the exposure of a \"specified anatomical area\" or by a \"specified sexual activity,\" or which regularly shows films, motion pictures, video cassettes, slides, or other photographic representations which depict or describe a \"specified sexual activity\" or \"specified anatomical area.\"\nb.\t\"Person\" means an individual, proprietorship, partnership, corporation, association, or other legal entity.\nc. \"Specified anatomical area\" means:\n(1) \tLess than completely and opaquely covered human genitals, pubic region, buttock or female breasts below a point immediately above the top of the areola; or\n(2) \tHuman male genitals in a discernibly turgid state, even if covered.\nd. \t\"Specified sexual activity\" means:\n(1) \tThe fondling or other erotic touching of covered or uncovered human genitals, pubic region, buttock or female breast; or\n(2) \tAny actual or simulated act of human masturbation, sexual intercourse or deviate sexual intercourse.\nL.1995,c.230,s.2.","path":["TITLE 2C THE NEW JERSEY CODE OF CRIMINAL JUSTICE"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"2f4b89eae6a1779da07291bc54055534f2a0e22be4f048e22f043ff0eb57aa41","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-2c-34-4","next":"us-nj/n.j.-stat.-2c-34-7"},"notice":"GroundRules: Original legal text.
