No person shall produce and deliver an ignition key or other device designed to operate a lock or locks on a motor vehicle or start a motor vehicle to any person on the basis of a motor vehicle identification number without obtaining and making a record of:\n(1)\tproof that the person requesting the ignition key or other device is the owner or lessee of the vehicle, or is a member of the same household as the owner or lessee of the vehicle, and which, at a minimum, shall include one of the following: a valid motor vehicle registration certificate, a valid insurance identification card, a valid insurance policy or a certificate of ownership; and\n(2)\tidentification of the person requesting the ignition key or other device, which identification shall include a photograph of the person.\nb.\tThe records made pursuant to the requirements of subsection a. of this section shall be retained for five years.\nc.\tNothing in this act shall be construed to deny a lessor or lienholder lawful access to a motor vehicle.\nd.\tA person who violates any provision of this act shall be guilty of a disorderly persons offense, except that notwithstanding the provisions of subsection c. of N.J.S.2C:43-3, a fine of not more than $2,000 may be imposed.\nL.2003,c.170.","path":["TITLE 2C THE NEW JERSEY CODE OF CRIMINAL JUSTICE"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"41bd65a71cf6ac0cdf886a5e05ae9ef81043fffd2a0ac87f0fda38a676c38344","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-2c-40-22","next":"us-nj/n.j.-stat.-2c-40-24"},"notice":"GroundRules: Original legal text.
