Any member of the staff at a facility for persons with developmental disabilities or  for persons with traumatic brain injury, and any member of the staff at a public or private agency, who violates the provisions of section 3 of P.L.2003, c.191 (C.30:6D-5.3) shall be liable to a civil penalty of $5,000 for the first offense, $10,000 for the second offense, and $25,000 for the third and each subsequent offense, to be sued for and collected in a summary proceeding by the commissioner pursuant to the \"Penalty Enforcement Law of 1999,\" P.L.1999, c.274 (C.2A:58-10 et seq.).\nb.\tA penalty collected pursuant to this section shall be dedicated to providing funding for training caregivers, as defined in section 2 of P.L.2010, c.5 (C.30:6D-74), and for site visits conducted pursuant to P.L.2017, c.238 (C.30:6D-9.1 et al.).\nL.2003, c.191, s.4; amended 2017, c.238, s.7.","path":["TITLE 30 INSTITUTIONS AND AGENCIES"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"4b77444b480d80a53d6003955393ad64ac08ba51d4cc87326d1f0da135450c44","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-30-6d-5.3","next":"us-nj/n.j.-stat.-30-6d-5.5"},"notice":"GroundRules: Original legal text.
