Stat. § 30:9A-20","heading":"Construction of act.","body":"3.\tNothing in this act shall be construed to:\na.\tlimit the authority of the Department of Health and Senior Services with respect to the licensure of a health care facility pursuant to P.L.1971, c.136 (C.26:2H-1 et seq.), regardless of whether the facility operates a separate psychiatric unit or service, or limit the authority of the Department of Human Services with respect to the licensure of an alcohol treatment facility pursuant to P.L.1975, c.305 (C.26:2B-7 et seq.), or the issuance of a certificate of approval to a narcotic and drug abuse treatment center pursuant to P.L.1970, c.334 (C.26:2G-21 et seq.);\nb.\trequire the licensure of any facility or center referenced in subsection a. of this section by the Department of Human Services; or\nc.\trequire licensure of a mental health agency which does not provide a mental health program that is subject to regulations adopted by the commissioner or the Commissioner of Children and Families, as applicable.\nL.1995, c.321, s.3; amended 2006, c.47, s.173.","path":["TITLE 30 INSTITUTIONS AND AGENCIES"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"ab34adbde892e3b00e2fdee77e72ab5ae79d2833ae4814ad8554f499fb80d575","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-30-9a-19","next":"us-nj/n.j.-stat.-30-9a-21"},"notice":"GroundRules: Original legal text.
