Stat. § 34:5-178","heading":"Violations;  penalties;  compromise of claims","body":"Any employer or any officer, agent or employee thereof who violates any of the provisions of this act shall be liable to a penalty of not less than $25.00  nor more than $500.00 to be collected in a civil action by a summary proceeding  under the penalty enforcement law (N.J.S. 2A:58-1 et seq.).  Any violation of  the act by an officer, agent or employee shall also be a violation of the act  by his employer if he had actual control over the cause of such violation.   Where the violation is of a continuing nature, each day during which it  continues after the date given by which the violation must be eliminated in  accordance with the order of the commissioner shall constitute an additional  separate and distinct offense, except during the time an appeal from said order  may be taken or is pending.\nThe commissioner is hereby authorized and empowered to compromise and settle  any claim for a penalty under this section in such amount in the discretion of  the commissioner as may appear appropriate and equitable under all of the  circumstances.\nL.1962, c. 45, s. 13.","path":["TITLE 34 LABOR AND WORKMEN'S COMPENSATION"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"6fdb79b9be02b1d4bdcac27f3b8617a920a0233fc231a187edffd58a752ce402","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-34-5-177","next":"us-nj/n.j.-stat.-34-5-179"},"notice":"GroundRules: Original legal text.
