Stat. § 39:4-50.21","heading":"Rules, regulations.","body":"6.\tPursuant to the \"Administrative Procedure Act,\" P.L.1968, c.410 (C.52:14B-1 et seq.), the division shall promulgate rules and regulations for the installation and use of ignition interlock devices.  These regulations shall be consistent with the federal model specifications for ignition interlock devices issued by the National Highway Traffic Safety Administration.  They shall include, but not be limited to, the following:\na.\trequiring that the ignition interlock system selected shall:\n(1)\tnot impede the safe operation of the vehicle;\n(2)\tincorporate features that make circumvention difficult and that do not interfere with the normal use of the vehicle;\n(3)\tcorrelate closely with established measures of alcohol impairment;\n(4)\toperate accurately and reliably in an unsupervised environment;\n(5)\tresist tampering and give evidence when tampering is attempted;\n(6)\tbe difficult to circumvent and require premeditation to do so;\n(7)\trequire a deep lung breath sample as a measure of blood alcohol concentration equivalence;\n(8)\toperate reliably over the range of automobile environments; and\n(9)\tbe manufactured by a party who will provide liability insurance.\nb.\tdesignating the facilities where ignition interlock devices may be installed;\nc.\testablishing guidelines for the proper use of ignition interlock devices; and\nd.\testablishing guidelines for the provision of ignition interlock devices at reduced rates to persons who, according to standards specified by the division, qualify as indigent.\nThe director may adopt at his discretion, in whole or in part, the guidelines, rules, regulations, studies, or independent laboratory tests performed on and relied upon in the certification of ignition interlock devices by other states, their agencies or commissions.\nL.1999,c.417,s.6.","path":["TITLE 39 MOTOR VEHICLES AND TRAFFIC REGULATION"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"5281169a4661af549d2e67a92975344b9f80619c20f6d07640f2e4f316c6dc53","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-39-4-50.20","next":"us-nj/n.j.-stat.-39-4-50.21a"},"notice":"GroundRules: Original legal text.
