Upon petition of a caregiver, the court may appoint the caregiver as kinship legal guardian of a child residing in the caregiver's home pursuant to the provisions of P.L. 2001, c. 250 (C. 3B:12A-1 et al.).\nb.\tA petition for the appointment of a kinship legal guardian shall include a kinship caregiver assessment, which shall contain:\n(1)\tthe full name and address of the person seeking to become the kinship legal guardian;\n(2)\tthe circumstances of the kinship relationship;\n(3)\tthe whereabouts of the child's parents, if known;\n(4)\tthe nature of the parents' incapacitation, if known;\n(5)\tthe wishes of the parents, if known;\n(6)\tthe ability of the kinship caregiver family to assume permanent care of the child;\n(7)\tthe child's property and assets, if known;\n(8)\tthe wishes of the child, if appropriate;\n(9)\tany current involvement of a child with the division if the child has an open division case and is actively receiving services;\n(10) certification from the caregiver that the caregiver has been providing care and support for the child, while the child has been residing in the caregiver's home, for at least the last six consecutive months or nine of the last 15 months;\n(11) the results from a criminal history record background check and a domestic violence central registry check of the caregiver and any adult residing in the caregiver's household conducted pursuant to section 9 of P.L. 2001, c. 250 (C. 30:4C-86);\n(12) the results from a child abuse record check arranged for and coordinated by the division pursuant to section 9 of P.L. 2001, c. 250 (C. 30:4C-86); and\n(13) the results of the caregiver's home review.\nL.2001,c.250,s.5; amended 2021, c.154, s.3.","path":["TITLE 3B ADMINISTRATION OF ESTATES--DECEDENTS AND OTHERS"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"66ebfadbea71ac72a4980099ad5d5581a554ba9b34c9a019d26099d084538b5f","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-3b-12a-4","next":"us-nj/n.j.-stat.-3b-12a-6"},"notice":"GroundRules: Original legal text.
