Stat. § 3B:14-61.7","heading":"Disclosure of content of electronic communications of deceased user.","body":"7.\tDisclosure of Content of Electronic Communications of Deceased User.\nIf a deceased user consented or a court directs disclosure of the contents of electronic communications of the user, the custodian shall disclose to the personal representative of the estate of the user the content of an electronic communication sent or received by the user if the representative gives the custodian:\na.\ta written request for disclosure in physical or electronic form;\nb.\ta copy of the death certificate of the user;\nc.\ta certificate evidencing the appointment of the representative or a small-estate affidavit;\nd.\tunless the user provided direction using an online tool, a copy of the user's will, trust, power of attorney, or other record evidencing the user's consent to disclosure of the content of electronic communications; and\ne.\tif requested by the custodian, any of the following:\n(1)\ta number, username, address, or other unique subscriber or account identifier assigned by the custodian to identify the user's account;\n(2)\tevidence linking the account to the user; or\n(3)\ta finding by the court of any of the following:\n(a)\tthe user had a specific account with the custodian, identifiable by the information specified in paragraph (1) of this subsection;\n(b)\tdisclosure of the content of electronic communications of the user would not violate 18 U.S.C. s.2701 et seq., Unlawful Access to Stored Communications; 47 U.S.C. s.222, Privacy of\nCustomer Information; or other applicable law;\n(c)\tunless the user provided direction using an online tool, the user consented to disclosure of the content of electronic communications; or\n(d)\tdisclosure of the content of electronic communications of the user is reasonably necessary for administration of the estate.\nL.2017, c.237, s.7.","path":["TITLE 3B ADMINISTRATION OF ESTATES--DECEDENTS AND OTHERS"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"1ccb9b496c6368b8f1074a81c0672975e5c1ec188e8f3ab8a7aa51dc00b4848a","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-3b-14-61.6","next":"us-nj/n.j.-stat.-3b-14-61.8"},"notice":"GroundRules: Original legal text.
