Stat. § 3B:14-61.8","heading":"Disclosure of other digital assets of deceased user.","body":"8.\tDisclosure of Other Digital Assets of Deceased User.\nUnless the user prohibited disclosure of digital assets or the court directs otherwise, a custodian shall disclose to the personal representative of the estate of a deceased user a catalogue of electronic communications sent or received by the user and digital assets, other than the content of electronic communications, of the user, if the representative gives the custodian:\na.\ta written request for disclosure in physical or electronic form;\nb.\ta copy of the death certificate of the user;\nc.\ta certificate evidencing the appointment of the representative or a small-estate affidavit; and\nd.\tif requested by the custodian, any of the following:\n(1)\ta number, username, address, or other unique subscriber or account identifier assigned by the custodian to identify the user's account;\n(2)\tevidence linking the account to the user;\n(3)\tan affidavit stating that disclosure of the user's digital assets is reasonably necessary for administration of the estate; or\n(4)\ta finding by the court of either of the following:\n(a)\tthe user had a specific account with the custodian, identifiable by the information specified in paragraph (1) of this subsection; or\n(b)\tdisclosure of the user's digital assets is reasonably necessary for administration of the estate.\nL.2017, c.237, s.8.","path":["TITLE 3B ADMINISTRATION OF ESTATES--DECEDENTS AND OTHERS"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"2357fc088b9e633be4a336551446ea5708df4fb1e3852f51d010fca1d9899da6","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-3b-14-61.7","next":"us-nj/n.j.-stat.-3b-14-61.9"},"notice":"GroundRules: Original legal text.
