Stat. § 3B:9-9","heading":"Bar of right to disclaim.","body":"Bar of right to disclaim.\na.\tThe right of an individual to disclaim property or any interest therein is barred by:\n(1)\tan assignment, conveyance, encumbrance, pledge or transfer of the property or interest or a contract therefor; or\n(2)\ta written waiver of the right to disclaim; or\n(3)\tan acceptance of the property or interest or a benefit under it after actual knowledge that a property right has been conferred; or\n(4)\ta sale of the property or interest that was seized under judicial process before the disclaimer is made; or\n(5)\tthe expiration of the permitted applicable perpetuities period; or\n(6)\ta fraud on the individual's creditors as set forth in the \"Uniform Voidable Transactions Act\" (R.S.25:2-20 et seq.).\nb.\tThe disclaimant shall not be barred from disclaiming all or any part of the balance of the property where the disclaimant has received a portion of the property and there still remains an interest which the disclaimant is yet to receive.\nc.\tA bar to the right to disclaim a present interest in joint property does not bar the right to disclaim a future interest in that property.\nd.\tThe right to disclaim may be barred to the extent provided by other applicable statutory law.\namended 1988, c.74, s.2; 2004, c.132, s.72; 2005, c.160, s.11; 2021, c.92, s.19.","path":["TITLE 3B ADMINISTRATION OF ESTATES--DECEDENTS AND OTHERS"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"4587d92de3da915254f1147ba0295266d762cc9752023aa3851d295bd7b7197e","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-3b-9-8","next":"us-nj/n.j.-stat.-3b-9-10"},"notice":"GroundRules: Original legal text.
