Stat. § 44:10-37","heading":"Certain income disregarded in computing benefit.","body":"4.\tIn computing the cash assistance benefit provided to recipients, the following disregards shall be applied to the earned income of each person in the assistance unit:\na.\tIn the case of a recipient who is employed an average of 20 hours or more a week:\n(1)\t100% of the earned income shall be disregarded for the first full month in which the earned income would be counted;\n(2)\t75% of the earned income shall be disregarded for six consecutive months of employment; and\n(3)\t50% of the earned income shall be disregarded for each continuous month of employment thereafter.\nb.\tIn the case of a recipient who is employed for an average of less than 20 hours a week:\n(1)\t100% of the earned income shall be disregarded for the first full month in which the earned income would be counted; and\n(2) 50% of the earned income shall be disregarded for each continuous month of employment thereafter.\nc.\tIf an employable recipient has a documented disability, as defined by the commissioner by regulation, that limits the person from accepting more than20 hours of employment per week, the commissioner may waive the 20 hours or more requirement in subsection a. of this section and provide that the recipient shall be entitled to the 75% earned income disregard for six consecutive months of employment, and the 50% earned income disregard for each continuous month of employment thereafter.\nL.1997,c.13,s.4; amended 2007, c.97, s.1.","path":["TITLE 44 POOR"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"211f55ac6154841d2d538de69bd4666eab96e2e4bf9efd8b8d93c2815fba198e","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-44-10-36","next":"us-nj/n.j.-stat.-44-10-38"},"notice":"GroundRules: Original legal text.
