Stat. § 45:14F-10.1","heading":"Ineligibility, revocation of license, registration, certification; rehabilitation.","body":"3. a. An applicant for licensure or certification under P.L.1991, c.68 (C.45:14F-1 et seq.) or registration under P.L.2017, c.72 (C.45:14F-27 et al.) shall not be eligible for licensure, certification or registration as the case may be, and any holder of a license or certification under P.L.1991, c.68 (C.45:14F-1 et seq.) or registration under P.L.2017, c.72 (C.45:14F-27 et al.) shall have his license, certification or registration revoked if the State Real Estate Appraiser Board determines, consistent with the requirements and standards of this section and section 4 of P.L.1997, c.401 (C.45:14F-10.2), that criminal history record information exists on file in the Federal Bureau of Investigation, Identification Division, or in the State Bureau of Identification in the Division of State Police, which would disqualify that individual from being licensed, certified or registered.  An applicant or a holder of a license, certification or registration shall be disqualified from licensure, certification or registration if that individual's criminal history record check reveals a record of conviction of any of the following crimes and offenses:\n(1)\tIn New Jersey, any crime or disorderly persons offense during the five-year period immediately prior to the date of the application or renewal; or\n(2)\tany crime more than five years prior to the date of the application or renewal:\n(a)\tInvolving danger to the person, meaning those crimes and disorderly persons offenses set forth in N.J.S.2C:11-1 et seq., N.J.S.2C:12-1 et seq., N.J.S.2C:13-1 et seq., N.J.S.2C:14-1 et seq., or N.J.S.2C:15-1 et seq.; or\n(b)\tInvolving theft as set forth in chapter 20 of Title 2C of the New Jersey Statutes, forgery and fraudulent practices as set forth in chapter 21 of Title 2C of the New Jersey Statutes, including but not limited to money laundering as set forth in N.J.S.2C:21-25, or perjury and other falsification in official matters as set forth in chapter 28 of Title 2C of the New Jersey Statutes; or\n(c)\tInvolving any controlled dangerous substances or controlled substance analog as set forth in chapter 35 of Title 2C of the New Jersey Statutes except as set forth in paragraph (4) of subsection a. of N.J.S.2C:35-10.\n(3)\tIn any other state or jurisdiction, conduct which, if committed in New Jersey, would constitute any of the crimes or disorderly persons offenses described in paragraph (1) or (2) of this subsection.\nFor purposes of this subsection, a judgment of conviction or a plea of guilty, non vult, nolo contendere or any other such disposition of alleged criminal activity shall be deemed a conviction.\nb.\tNotwithstanding the provisions of subsection a. of this section, no individual shall be disqualified from licensure, certification or registration on the basis of any conviction disclosed by a criminal history record check performed pursuant to this section, other than a conviction for a crime during the five-year period immediately prior to the date of the application or renewal or a crime enumerated in subparagraph (b) of paragraph (2) of subsection a. of this section, if the individual has affirmatively demonstrated to the board clear and convincing evidence of his rehabilitation.  In determining whether an individual has affirmatively demonstrated rehabilitation, the following factors shall be considered:\n(1)\tThe nature and responsibility of the position which the convicted individual would hold;\n(2)\tThe nature and seriousness of the offense;\n(3)\tThe circumstances under which the offense occurred;\n(4)\tThe date of the offense;\n(5)\tThe age of the individual when the offense was committed;\n(6)\tWhether the offense was an isolated or repeated incident;\n(7)\tAny social conditions which may have contributed to the offense; and\n(8)\tAny evidence of rehabilitation, including good conduct in prison or in the community, counseling or psychiatric treatment received, acquisition of additional academic or vocational schooling, successful participation in correctional work-release programs, or the recommendation of persons who have had the individual under their supervision.\nL.1997, c.401, s.3; amended 2017, c.72, s.26.","path":["TITLE 45 PROFESSIONS AND OCCUPATIONS"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"f4212a8e1333f9cf1a80cedbbb452ac1798939861f474b0af50db5eb8db6091d","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-45-14f-10","next":"us-nj/n.j.-stat.-45-14f-10.2"},"notice":"GroundRules: Original legal text.
