Unless the method of disposition is adopted for purposes of evasion, the provision of this act shall not apply to offers or dispositions:\n(1)\tBy an owner for the owner’s own account in a single or isolated transaction;\n(2)\tWholly for industrial, commercial, or other nonresidential purposes;\n(3)\tPursuant to court order;\n(4)\tBy the United States or by this State or any of its agencies or political subdivisions;\n(5)\tOf real property located without the State;\n(6)\tOf cemetery lots or interests;\n(7)\tOf less than 100 lots, parcels, units, or interests; provided, however, that with respect to condominiums and cooperatives, this exemption shall not apply, irrespective of the number of lots, parcels, units, or interests offered or disposed of;\n(8)\tOf developments where the common elements or interests, which would otherwise subject the offering to this act, are limited to the provision of unimproved, unencumbered open space;\n(9)\tIn a development composed wholly of rental units, where the relationship created is one of landlord and tenant;\n(10)  Of any form of timesharing;\n(11)  Of a private residential leasehold community to a resident homeowner group or its assignee pursuant to P.L.1991, c.483 (C.46:8C-10 et seq.), whether or not the form of ownership of the private residential leasehold community would otherwise fall within the definition of planned real estate development pursuant to \"The Planned Real Estate Development Full Disclosure Act,\" P.L.1977, c.419 (C.45:22A-21 et seq.).\nb.\tThe agency may, from time to time, pursuant to its rules and regulations, exempt from any of the provisions of this act any development, or any lots, units, parcels, or interests in a development, if it finds that the enforcement of this act with respect to such is not necessary in the public interest or required for the protection of purchasers by reason of the small amount of the purchase price involved, the limited character of the offering, or the limited nature of the common or shared elements.\nL.1977, c.419, s.5; amended 2006, c.63, s.40; 2025, c.362, s.11.","path":["TITLE 45 PROFESSIONS AND OCCUPATIONS"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"cdd644441173fb9df42945ad92e6d54bf925de58372a0a686097af58d43e5c36","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-45-22a-24","next":"us-nj/n.j.-stat.-45-22a-26"},"notice":"GroundRules: Original legal text.
