Stat. § 45:5AAA-12","heading":"Applicability, exceptions, \"The New Home Warranty and Builders' Registration Act\" registered, professions, certain.","body":"11.\tThe provisions of sections 7, 8, 9, 12, 13, 17, and 20 through 23 of P.L.2023, c.237 (C.45:5AAA-7 et al.) shall not apply to:\na.\tAny individual required to register pursuant to \"The New Home Warranty and Builders' Registration Act,\" P.L.1977, c.467 (C.46:3B-1 et seq.), but only in conjunction with the building of a new home as defined in section 2 of P.L.1977, c.467 (C.46:3B-2);\nb.\tAny individual regulated by the State as an architect, professional engineer, landscape architect, land surveyor, electrical contractor, master plumber, or any other individual in any other related profession requiring registration, certification, or licensure by the State, who is acting within the scope of practice of the individual's profession;\nc.\tAny individual who is employed by a common interest community, including, but not limited to, a community association or cooperative corporation, or by the owner or manager of any other residential property, while the individual is acting within the scope of that employment;\nd.\tAny public utility as defined under R.S.48:2-13;\ne.\tAny individual licensed under the provisions of section 16 of P.L.1960, c.41 (C.17:16C-77) but only in conjunction with selling a home repair contract as defined in section 1 of P.L.1960, c.41 (C.17:16C-62) and as also applicable to P.L.1968, c.224 (C.17:16C-95 et seq.);\nf.\tAny home improvement or home elevation retailer with sales of more than $50,000,000, or employee of that retailer while acting on behalf of that retailer; and\ng.\tAny individual who is seeking a license in home improvement pursuant to paragraph (2) of subsection b. in section 7 of P.L.2023, c.237 (C.45:5AAA-7).\nL.2023, c.237, s.11.","path":["TITLE 45 PROFESSIONS AND OCCUPATIONS"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"3b57588d0cdacaf73a81d59a1f082a46eafe84ca947aa1400ee84ed9aeef53e4","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-45-5aaa-11","next":"us-nj/n.j.-stat.-45-5aaa-13"},"notice":"GroundRules: Original legal text.
