Stat. § 52:17B-194.5","heading":"Activation of Silver Alert; requirements.","body":"2.\tA Silver Alert authorized under this section may be activated in accordance with the following requirements, which shall be incorporated into the guidelines required by subsection c. of section 1 of P.L.2009, c.167 (C.52:17B-194.4).\na.\tThe law enforcement agency receiving the missing persons report shall be the lead law enforcement agency.\nb.\tThe Missing Persons and Child Exploitation Unit in the Division of State Police, upon request, shall assist the lead law enforcement agency in the investigation of a Silver Alert.\nc.\tEach of the following criteria shall be met before a Silver Alert may be issued:\n(1)\tthe person believed to be missing is believed to have dementia or another cognitive impairment regardless of age;\n(2)\ta missing person's report has been submitted to the local law enforcement agency where the person went missing;\n(3)\tthe person believed to be missing may be in danger of death or serious bodily injury;\n(4)\tthere is sufficient information available to indicate that a Silver Alert would assist in locating the missing person; and\n(5)\tsufficient information is available to disseminate to the public that could assist in locating the person.\nL.2009, c.167, s.2; amended 2017, c.131, s.189.","path":["TITLE 52 STATE GOVERNMENT, DEPARTMENTS AND OFFICERS"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"6f02f3356476f3863168756bda4981eed79477e6b0e94e6558b3991abd96ad9f","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-52-17b-194.4","next":"us-nj/n.j.-stat.-52-17b-194.6"},"notice":"GroundRules: Original legal text.
