Receipts from sales of the following sold for human use are exempt from the tax imposed under the \"Sales and Use Tax Act\":\n(1)\tdrugs sold pursuant to a doctor's prescription;\n(2)\tover-the-counter drugs;\n(3)\tdiabetic supplies;\n(4)\tprosthetic devices;\n(5)\ttampons or like products;\n(6)\tmedical oxygen;\n(7)\thuman blood and its derivatives;\n(8)\tdurable medical equipment for home use;\n(9)\tmobility enhancing equipment sold by prescription; and\n(10) repair and replacement parts for any of the foregoing exempt devices and equipment.\nb.\tAs used in this section:\n\"Drug\" means a compound, substance, or preparation, and any component of a compound, substance, or preparation, other than food and food ingredients, dietary supplements, or alcoholic beverages:\n(1)\trecognized in the official United States Pharmacopoeia, official Homeopathic Pharmacopoeia of the United States, or official National Formulary, and supplement to any of them; or\n(2)\tintended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease; or\n(3)\tintended to affect the structure or any function of the body.\n\"Over-the-counter-drug\" means a drug that contains a label which identifies the product as a drug, required by 21 CFR 201.66.  The label includes:\n(1)\ta \"Drug Facts\" panel or\n(2)\ta statement of the \"active ingredient\" or \"active ingredients\" with a list of those ingredients contained in the compound, substance or preparation. \"Over-the-counter drug\" does not include a grooming and hygiene product.\n\"Grooming and hygiene product\" is soap or cleaning solution, shampoo, toothpaste, mouthwash, anti-perspirant, or sun tan lotion or screen, regardless of whether the item meets the definition of \"over-the-counter drug.\"\n\"Prescription\" means an order, formula, or recipe issued in any form of oral, written, electronic, or other means of transmission by a duly licensed practitioner authorized by the laws of this State.\n\"Prosthetic device\" means a replacement, corrective, or supportive device including repair and replacement parts for same worn on or in the body in order to:\n(1)\tartificially replace a missing portion of the body; or\n(2)\tprevent or correct a physical disability; or\n(3)\tsupport a weak or disabled portion of the body.\n\"Durable medical equipment\" means equipment, including repair and replacement parts, but not including mobility enhancing equipment, that:\n(1)\tcan withstand repeated use;\n(2)\tis primarily and customarily used to serve a medical purpose;\n(3)\tis generally not useful to a person in the absence of illness or injury; and\n(4)\tis not worn in or on the body.\n\"Mobility enhancing equipment\" means equipment, including repair and replacement parts, other than durable medical equipment, that:\n(1)\tis primarily and customarily used to provide or increase the ability to move from one place to another and which is appropriate for use either at home or in a motor vehicle; and\n(2)\tis not generally used by persons with typical mobility; and\n(3)\tdoes not include any motor vehicle or equipment on a motor vehicle normally provided by a motor vehicle manufacturer.\nc.\tReceipts from sales of supplies purchased for use in providing medical services for compensation, but not transferred to the purchaser of the service in conjunction with the performance of the service, shall be considered taxable receipts from retail sales notwithstanding the exemption from the tax imposed under the \"Sales and Use Tax Act\" provided under this section.\nL.1980, c.105, s.13; amended 1982, c.227, s.5; 1987, c.383; 2005, c.126, s.7; 2008, c.123, s.6; 2017, c.131, s.214.","path":["TITLE 54 TAXATION"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"2aa6dba918b138b64b86c016d8bd6c1040e8f0c184043f853ab9d72841decce7","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-54-32b-7.1","next":"us-nj/n.j.-stat.-54-32b-8.2"},"notice":"GroundRules: Original legal text.
