Stat. § 54:4-3.113e","heading":"Revocation of certificate.","body":"5.\tThe local enforcing agency, after giving notice to the holder of a renewable energy system certificate, may revoke a certificate whenever any of the following appears or occurs:\na.\tthe certificate was obtained by fraud or misrepresentation;\nb.\tthe claimant for tax exemption has failed substantially to proceed with the construction, reconstruction, installation or acquisition of a renewable energy system;\nc.\tthe structure or equipment or both to which the certificate relates has ceased to be used for the primary purpose of providing renewable energy to provide all or a portion of the electrical, heating, cooling, or general energy needs of the structure and is being used for a different primary purpose; or\nd.\tthe claimant for the tax exemption has so departed from the equipment, design and construction previously certified by the local enforcing agency that, in the opinion of the local enforcing agency, the renewable energy system is not suitable and reasonably adequate for the purpose of using renewable energy to provide all or a portion of the electrical, heating, cooling, or general energy needs of the structure.\nL.2008, c.90, s.5.","path":["TITLE 54 TAXATION"],"source_url":"https://pub.njleg.state.nj.us/statutes/STATUTES-TEXT.zip","current_through":"P.L.2025, c.405, and J.R.22","vintage":"","retrieved_at":"2026-08-27T17:54:13Z","sha256":"02a419c7db00c4339bfb703f158216a052b5c78115534a7a3e149b1c92be579c","source_id":"us-nj","stale":true,"prev":"us-nj/n.j.-stat.-54-4-3.113d","next":"us-nj/n.j.-stat.-54-4-3.113f"},"notice":"GroundRules: Original legal text.
