{"data":{"id":"us-nm/10-12c-4","jurisdiction":"us-nm","citation":"10-12C-4","heading":"Membership.","body":"Unless an irrevocable exemption is filed pursuant to Subsection C of Section 10-12C-16 NMSA 1978, every magistrate while in office shall become a member and shall be subject to the provisions of the Magistrate Retirement Act. A magistrate who is retired under any state system or the educational retirement system, including a magistrate who is otherwise exempt from the provisions of the Magistrate Retirement Act, shall:\nA. pay the applicable member contributions and the state, through the administrative office of the courts, shall pay the applicable employer contributions as provided pursuant to the Magistrate Retirement Act; and\nB. not accrue a service credit and shall not be eligible to purchase service credit nor to retire pursuant to the Magistrate Retirement Act.","path":["Chapter 10 - Public Officers and Employees","ARTICLE 12C Magistrate Retirement"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18510/index.do","current_through":"2026-07-01","vintage":"","retrieved_at":"2026-09-03T15:02:19Z","sha256":"c8a643da0dc10e7a6c3b6751c07a15dd91cf2d1cefb5f70267f9fa6630c3edc4","source_id":"us-nm","stale":false,"prev":"us-nm/10-12c-3","next":"us-nm/10-12c-5"},"notice":"GroundRules: Original legal text.
