{"data":{"id":"us-nm/10-16-2","jurisdiction":"us-nm","citation":"10-16-2","heading":"Definitions.","body":"As used in the Governmental Conduct Act:\nA. \"business\" means a corporation, partnership, sole proprietorship, firm, organization or individual carrying on a business;\nB. \"confidential information\" means information that by law or practice is not available to the public;\nC. \"contract\" means an agreement or transaction having a value of more than one thousand dollars ($1,000) with a state or local government agency for:\n(1) the rendition of services, including professional services;\n(2) the furnishing of any material, supplies or equipment;\n(3) the construction, alteration or repair of any public building or public work;\n(4) the acquisition, sale or lease of any land or building;\n(5) a licensing arrangement;\n(6) a loan or loan guarantee; or\n(7) the purchase of financial securities or instruments;\nD. \"employment\" means rendering of services for compensation in the form of salary as an employee;\nE. \"family\" means an individual's spouse, parents, children or siblings, by consanguinity or affinity;\nF. \"financial interest\" means an interest held by an individual or the individual's family that is:\n(1) an ownership interest in business or property; or\n(2) any employment or prospective employment for which negotiations have already begun;\nG. \"local government agency\" means a political subdivision of the state or an agency of a political subdivision of the state;\nH. \"official act\" means an official decision, recommendation, approval, disapproval or other action that involves the use of discretionary authority;\nI. \"public officer or employee\" means any elected or appointed official or employee of a state agency or local government agency who receives compensation in the form of salary or is eligible for per diem or mileage but excludes legislators;\nJ. \"standards\" means the conduct required by the Governmental Conduct Act;\nK. \"state agency\" means any branch, agency, instrumentality or institution of the state; and\nL. \"substantial interest\" means an ownership interest that is greater than twenty percent.","path":["Chapter 10 - Public Officers and Employees","ARTICLE 16 Governmental Conduct"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18510/index.do","current_through":"2026-07-01","vintage":"","retrieved_at":"2026-09-03T15:02:19Z","sha256":"ea286520929cddad1eff12455f9ac2036c09f5e6eb8ebd3c6d2afd03f753b7f9","source_id":"us-nm","stale":false,"prev":"us-nm/10-16-1","next":"us-nm/10-16-3"},"notice":"GroundRules: Original legal text.
