{"data":{"id":"us-nm/22-8b-5.3","jurisdiction":"us-nm","citation":"22-8B-5.3","heading":"Chartering authority; powers; duties; liability.","body":"A chartering authority shall:\nA. evaluate charter applications;\nB. actively pursue the utilization of charter schools to satisfy identified education needs and promote a diversity of educational choices;\nC. approve charter applications that meet the requirements of the Charter Schools Act;\nD. decline to approve charter applications that fail to meet the requirements of the Charter Schools Act or are otherwise inadequate;\nE. negotiate and execute, in good faith, charter contracts that meet the requirements of the Charter Schools Act with each approved charter school;\nF. monitor, in accordance with the requirements of the Charter Schools Act and the terms of the charter contract, the performance and legal compliance of charter schools under their authority;\nG. determine whether a charter school merits suspension, revocation or nonrenewal; and\nH. develop and maintain chartering policies and practices consistent with nationally recognized principles and standards for quality charter authorizing in all major areas of authorizing, including:\n(1) organizational capacity and infrastructure;\n(2) evaluating charter applications;\n(3) performance contracting;\n(4) charter school oversight and evaluation; and\n(5) charter school suspension, revocation and renewal processes.","path":["Chapter 22 - Public Schools","ARTICLE 8B Charter Schools"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18522/index.do","current_through":"2026-07-01","vintage":"","retrieved_at":"2026-09-03T15:02:19Z","sha256":"6a7b592e040e4c7d9004abbf308574f5d4e6520b687c10d2bc0428e67825025a","source_id":"us-nm","stale":false,"prev":"us-nm/22-8b-5.2","next":"us-nm/22-8b-5.4"},"notice":"GroundRules: Original legal text.
