{"data":{"id":"us-nm/24-26-2","jurisdiction":"us-nm","citation":"24-26-2","heading":"Definitions.","body":"As used in the Patient Care Monitoring Act:\nA. \"department\" means the aging and long-term services department;\nB. \"facility\" means a long-term care facility licensed pursuant to the provisions of Section 24-1-5 NMSA 1978, other than an intermediate care facility for individuals with developmental or intellectual disabilities, and may also include:\n(1) a skilled nursing facility;\n(2) an intermediate care nursing facility;\n(3) a nursing facility;\n(4) an adult residential shelter care home;\n(5) a boarding home;\n(6) any adult care home or adult residential care facility; and\n(7) any swing bed in an acute care facility or extended care facility;\nC. \"monitoring device\" means a surveillance instrument that broadcasts or records activity, but does not include a still camera;\nD. \"patient\" means a person who is a resident of a facility;\nE. \"program\" means the New Mexico long-term care ombudsman program; and\nF. \"surrogate\" means a legal guardian or a legally appointed substitute decision-maker who is authorized to act on behalf of a patient.","path":["Chapter 24 - Health and Safety","ARTICLE 26 Patient Care Monitoring Act"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18524/index.do","current_through":"2026-07-01","vintage":"","retrieved_at":"2026-09-03T15:02:19Z","sha256":"b5950e29660d8ca7b1198aef689d055c2e585ed48e361f2234b940d39c930ea4","source_id":"us-nm","stale":false,"prev":"us-nm/24-26-1","next":"us-nm/24-26-3"},"notice":"GroundRules: Original legal text.
