Except as provided in Subsection D of this section, beginning January 1, 2027, a hospital or health system shall not charge, bill or collect a facility fee directly from a patient for:\n(1) preventive health care services provided in an outpatient setting, including services accessed from the patient's vehicle;\n(2) vaccination services provided in an outpatient setting, including services accessed from the patient's vehicle; or\n(3) telehealth services.\nB. Nothing in this section prohibits a hospital or health system from charging a facility fee for:\n(1) health care services provided in an inpatient setting;\n(2) health care services provided at a hospital emergency department; or\n(3) health care services provided at a freestanding emergency department.\nC. Nothing in this section prohibits a hospital or health system from charging, billing or collecting a facility fee from a patient's insurer pursuant to an agreement between the hospital or health system and the insurer or as required by law.\nD. The provisions of Subsection A of this section shall not apply to a hospital or a hospital's clinic located in a rural area.\nE. Notwithstanding the provisions of Subsections B, C and D of this section, a hospital or health system shall not charge, bill or collect a facility fee directly from a patient who does not have health insurance coverage and is provided the benefits of a health care service for which a facility fee would otherwise be charged.","path":["Chapter 24 - Health and Safety","ARTICLE 37 Fair Pricing for Routine Medical Care"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18524/index.do","current_through":"2026-07-01","vintage":"","retrieved_at":"2026-09-03T15:02:19Z","sha256":"5372b79a10c0082dae062bcdceb747427f0ebe67638d9a8bf94e94acbd81d251","source_id":"us-nm","stale":false,"prev":"us-nm/24-37-2","next":"us-nm/24-37-4"},"notice":"GroundRules: Original legal text.
