Except as provided by Subsection B of this section, the supported decision-making agreement extends until terminated by either party or by the terms of the agreement.\nB. The supported decision-making agreement is terminated as to a particular supporter if:\n(1) the adult protective services division of the aging and long-term services department finds that the decision-maker has been abused, neglected or exploited by the supporter;\n(2) the supporter is the subject of a civil or criminal order prohibiting contact with the decision-maker;\n(3) the supporter has been placed on the state's employee abuse registry;\n(4) the supporter has been convicted of a crime involving violence or dishonesty;\n(5) the supporter is incarcerated;\n(6) the decision-maker gives notice to the supporter orally, in writing, through an assistive technology device or by any other means or act showing a specific intent to terminate the agreement; or\n(7) the supporter provides written notice of the supporter's resignation to the decision-maker.","path":["Chapter 24 - Health and Safety","ARTICLE 7D Supported Decision-Making"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18524/index.do","current_through":"2026-07-01","vintage":"","retrieved_at":"2026-09-03T15:02:19Z","sha256":"379b1dc987f21ee2dfc70e206345bbee62018d7f018a3bac18a9646c46d5ae30","source_id":"us-nm","stale":false,"prev":"us-nm/24-7d-11","next":"us-nm/24-7d-13"},"notice":"GroundRules: Original legal text.
