Unless required by federal law, a health facility shall establish the same criteria for granting patient admitting or discharge privileges or in authorizing continuing patient care for certified nurse practitioners, certified nurse-midwives and clinical nurse specialists as the health facility has established for physicians.\nB. A health facility shall ensure that certified nurse practitioners, certified nurse-midwives and clinical nurse specialists acting in accordance with these professionals' respective scopes of practice under New Mexico law are:\n(1) eligible to serve on the health facility's medical staff;\n(2) credentialed under the same procedures as the health facility has established for physicians; and\n(3) authorized to conduct peer review of their professional colleagues.\nC. As used in this section:\n(1) \"certified nurse-midwife\" means a person licensed as a registered nurse pursuant to the Nursing Practice Act [Chapter 61, Article 3 NMSA 1978] and licensed by the department of health as a certified nurse-midwife;\n(2) \"certified nurse practitioner\" means a registered nurse who is licensed by the board of nursing for advanced practice as a certified nurse practitioner pursuant to the Nursing Practice Act;\n(3) \"clinical nurse specialist\" means a registered nurse who is licensed by the board of nursing for advanced practice as a clinical nurse specialist and whose name and pertinent information are entered on the list of clinical nurse specialists maintained by the board of nursing;\n(4) \"health facility\" means a health facility licensed by the authority; and\n(5) \"physician\" means a person licensed to practice as a medical doctor or an osteopathic physician.","path":["Chapter 24A - Health Care Code","ARTICLE 1 Health Care Code"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18974/index.do","current_through":"2026-05-20","vintage":"","retrieved_at":"2026-09-03T15:02:19Z","sha256":"dff491f0f8862b516adc8477a8f29f94223d106290b0875658150e6444fb01ce","source_id":"us-nm","stale":false,"prev":"us-nm/24a-1-12","next":"us-nm/24a-1-14"},"notice":"GroundRules: Original legal text.
