For the purposes of this section:\n(1) \"birth center\" means a freestanding birth center licensed by the state for the primary purpose of performing low-risk deliveries that is not a hospital, attached to a hospital or in a hospital and where births are planned to occur away from the pregnant person's residence following a low-risk pregnancy;\n(2) \"medicaid\" means the medical assistance program established pursuant to Title 19 of the federal Social Security Act and regulations issued pursuant to that act; and\n(3) \"medicaid recipient\" means a person whom the department has determined to be eligible to receive medicaid-related services.\nB. The secretary shall adopt rules that:\n(1) create a methodology to determine medicaid facility fee reimbursement rates for birth centers that are comparable to rates for similar services provided at a hospital; and\n(2) require annual increases to birth center facility fee reimbursement rates that are equivalent to hospital reimbursement rate increases.","path":["Chapter 27 - Public Assistance","ARTICLE 2 Public Assistance Act"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18527/index.do","current_through":"2026-07-01","vintage":"","retrieved_at":"2026-09-03T15:02:19Z","sha256":"537a98cbac13fef0472e5760320e8cba7e3c40f1891f35d3e315c5d2ef1c58ce","source_id":"us-nm","stale":false,"prev":"us-nm/27-2-12.35","next":"us-nm/27-2-12.37"},"notice":"GroundRules: Original legal text.
