{"data":{"id":"us-nm/3-49-1","jurisdiction":"us-nm","citation":"3-49-1","heading":"Streets; sidewalks; curbs and gutters; public grounds.","body":"A municipality may lay out, establish, open, vacate, alter, repair, widen, extend, grade, pave or otherwise improve streets; including, but not necessarily limited to median and divider strips, parkways and boulevards; alleys, avenues, sidewalks, curbs, gutters and public grounds, and may:\nA. regulate their use and use of structures under them;\nB. prohibit and remove encroachments or obstructions on them;\nC. provide for their lighting, cleaning, beautification, landscaping and maintenance;\nD. regulate their opening or repair;\nE. require the owner or occupant of any premise to keep the sidewalk, along the premise, free from any snow or other obstruction;\nF. regulate and prohibit the throwing or depositing of any offensive matter on them;\nG. prohibit injury to them;\nH. provide for and regulate crosswalks, curbs and gutters;\nI. regulate and prohibit their use for signs, signposts, awnings, awning posts, telegraph poles, horse troughs, posting handbills and advertisements;\nJ. regulate and prohibit the exhibition or carrying of banners, placards, advertisements or handbills in the streets or upon the sidewalks;\nK. regulate and prohibit the flying of banners, flags or signs across the streets or from houses;\nL. regulate traffic and sales upon streets, sidewalks and public places;\nM. regulate the numbering of lots and houses;\nN. name and change the name of any street, alley, avenue or other public place; and\nO. with the written consent of the owner, regulate the speed and traffic conditions on private property.","path":["Chapter 3 - Municipalities","ARTICLE 49 Streets, Sidewalks and Public Grounds"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18504/index.do","current_through":"2026-07-01","vintage":"","retrieved_at":"2026-09-03T15:02:19Z","sha256":"3822c3cdc8df5c774992c879758ca7022c98126caf4f6f18eb90b2899d096165","source_id":"us-nm","stale":false,"prev":"us-nm/3-48-7","next":"us-nm/3-49-2"},"notice":"GroundRules: Original legal text.
