{"data":{"id":"us-nm/30-12-2","jurisdiction":"us-nm","citation":"30-12-2","heading":"Grounds for order of interception.","body":"An ex parte order for wiretapping, eavesdropping or the interception of any wire or oral communication may be issued by any judge of a district court upon application of the attorney general or a district attorney, stating that there is probable cause to believe that:\nA. evidence may be obtained of the commission of:\n(1) the crime of murder, kidnapping, extortion, robbery, trafficking or distribution of controlled substances or bribery of a witness;\n(2) the crime of burglary, aggravated burglary, criminal sexual penetration, arson, mayhem, receiving stolen property or commercial gambling, if punishable by imprisonment for more than one year; or\n(3) an organized criminal conspiracy to commit any of the aforementioned crimes; or\nB. the communication, conversation or discussion is itself an element of any of the above specified crimes.","path":["Chapter 30 - Criminal Offenses","ARTICLE 12 Abuse of Privacy"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18530/index.do","current_through":"2026-07-01","vintage":"","retrieved_at":"2026-09-03T15:02:19Z","sha256":"e1a2df3e60033b4b8cb5a38214ff442997664bbe9d778a64267c3d6672143b37","source_id":"us-nm","stale":false,"prev":"us-nm/30-12-1","next":"us-nm/30-12-3"},"notice":"GroundRules: Original legal text.
