{"data":{"id":"us-nm/32a-30-2","jurisdiction":"us-nm","citation":"32A-30-2","heading":"Definitions.","body":"As used in the Office of Child Advocate Act:\nA. \"child in custody\" means a minor who is placed by the department in custodial or residential care, including foster care, kinship care or care within a group home, a residential treatment center, a juvenile justice facility, a semi-independent living program or an emergency shelter, pursuant to a court order or otherwise sanctioned by the court and does not live with either of the child's birth parents;\nB. \"committee\" means the state child advocate selection committee;\nC. \"department\" means the children, youth and families department;\nD. \"near fatality\" means an injury or condition caused by abuse or neglect that results in a child:\n(1) being placed in serious or critical condition, as certified by a licensed physician; and\n(2) receiving critical care for at least twenty-four hours following the child's admission to a critical care unit; and\nE. \"office\" means the office of child advocate.","path":["Chapter 32A - Children's Code","ARTICLE 30 Office of Child Advocate"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18532/index.do","current_through":"2026-07-01","vintage":"","retrieved_at":"2026-09-03T15:02:19Z","sha256":"1a632f49b2ce07181a4f8d1295a193bf661db0f6e681a03d35986bee9eabd0b3","source_id":"us-nm","stale":false,"prev":"us-nm/32a-30-1","next":"us-nm/32a-30-3"},"notice":"GroundRules: Original legal text.
