{"data":{"id":"us-nm/33-2-43","jurisdiction":"us-nm","citation":"33-2-43","heading":"Penitentiary inmate-release program; establishment.","body":"The superintendent [warden] of the penitentiary of New Mexico may institute an inmate-release program and allow penitentiary inmates to attend school or to be employed in private business while under sentence of confinement in the penitentiary if:\nA. employment of a prisoner does not result in the displacement of employed workers or impair existing contracts for services and is not in a skill, craft or trade in which a surplus of available gainful labor exists in the locality;\nB. rates of pay and other conditions of employment are not less than those paid or provided for work of a similar nature in the locality in which the work is performed;\nC. prisoners authorized to work at paid employment under the inmate-release program are required to pay appropriate and reasonable costs incident to the program and to their confinement as prescribed by the superintendent; and\nD. prisoners participating in the inmate-release program are volunteers who meet standards prescribed by law.","path":["Chapter 33 - Correctional Institutions","ARTICLE 2 State Correctional Facilities"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18533/index.do","current_through":"2025-08-14","vintage":"","retrieved_at":"2026-09-03T15:02:19Z","sha256":"b419385d2f0a89f4cf286b15ee799fa45d965db8b87f95c48704cd2254662bdc","source_id":"us-nm","stale":false,"prev":"us-nm/33-2-41","next":"us-nm/33-2-44"},"notice":"GroundRules: Original legal text.
