{"data":{"id":"us-nm/33-2a-3","jurisdiction":"us-nm","citation":"33-2A-3","heading":"Definitions.","body":"As used in the Corrections Population Control Act:\nA. \"commission\" means the corrections population control commission;\nB. \"female correctional facilities\" means:\n(1) the women's correctional facility, located in Grants; and\n(2) any other female correctional facility so designated by the corrections department;\nC. \"male correctional facilities\" means:\n(1) the penitentiary of New Mexico, located in Santa Fe;\n(2) the central New Mexico correctional facility, located in Los Lunas;\n(3) the southern New Mexico correctional facility, located in Las Cruces;\n(4) the western New Mexico correctional facility, located in Grants;\n(5) the Roswell correctional facility, located in Hagerman;\n(6) the Guadalupe county correctional facility, located in Santa Rosa;\n(7) the Lea county correctional facility, located in Hobbs; and\n(8) any other male correctional facility so designated by the corrections department;\nD. \"nonviolent offender\" means:\n(1) a person convicted only of possession of a controlled substance, pursuant to the provisions of Section 30-31-23 NMSA 1978;\n(2) a person incarcerated for violating the conditions of his parole plan due to use or possession of a controlled substance whose original conviction was for commission of a nonviolent offense; or\n(3) an inmate designated by the commission as a nonviolent offender; provided that the offender was convicted for the commission of a nonviolent offense, as that term is defined in Subsection L [N] of Section 33-2-34 NMSA 1978; and\nE. \"rated capacity\" means the actual general population bed space, including only individual cells and areas designed for the long-term housing of inmates, available in female correctional facilities or male correctional facilities as certified by the secretary of corrections and subject to applicable state and federal law.","path":["Chapter 33 - Correctional Institutions","ARTICLE 2A Corrections Population Control"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18533/index.do","current_through":"2025-08-14","vintage":"","retrieved_at":"2026-09-03T15:02:19Z","sha256":"fd2a93a0d80e3d4a63c2fd2ca24143e563c5d26019d6c413b7b60c8ab86c3418","source_id":"us-nm","stale":false,"prev":"us-nm/33-2a-2","next":"us-nm/33-2a-4"},"notice":"GroundRules: Original legal text.
