{"data":{"id":"us-nm/33-3b-2","jurisdiction":"us-nm","citation":"33-3B-2","heading":"Definitions.","body":"As used in the County Detention Facility Reimbursement Act:\nA. \"county detention facility\" means a facility that is owned, operated or under contract of operation by a board of county commissioners and that is used for the incarceration of prisoners charged with or convicted of a violation of local, state, tribal, federal or international law;\nB. \"division\" means the local government division of the department of finance and administration;\nC. \"dual supervision offender\" means an individual who is serving a probation term and a parole term;\nD. \"eligible county\" means a county that provides information to the New Mexico sentencing commission regarding costs incurred by the county for the incarceration of felony offenders;\nE. \"felony offender\" means an individual who is convicted of a felony and sentenced to confinement in a correctional facility designated by the corrections department and who:\n(1) has been released from confinement and is a dual supervision offender and:\n(a) has violated parole or is charged with a parole violation;\n(b) has violated probation or is charged with a probation violation; or\n(c) while on probation or parole, is charged with a violation of local, state, tribal, federal or international law;\n(2) has been released from confinement and is serving a parole term and:\n(a) has violated parole or is charged with a parole violation; or\n(b) while on parole, is charged with a violation of local, state, tribal, federal or international law; or\n(3) is awaiting transportation and commitment to the corrections department following the revocation of parole or a sentencing hearing for a felony conviction; and\nF. \"fund\" means the county detention facility reimbursement fund.","path":["Chapter 33 - Correctional Institutions","ARTICLE 3B County Detention Facility Reimbursement Act"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18533/index.do","current_through":"2025-08-14","vintage":"","retrieved_at":"2026-09-03T15:02:19Z","sha256":"586a8ee8b55c83c0729627d298a25984d57e6eab5d681bf05d24c7c0281a8a3c","source_id":"us-nm","stale":false,"prev":"us-nm/33-3b-1","next":"us-nm/33-3b-3"},"notice":"GroundRules: Original legal text.
