Personnel rules shall be promulgated by the district attorneys and shall be effective when filed as required by law.\nB. The personnel rules of the district attorneys shall include provisions governing:\n(1) a classification plan for all positions;\n(2) a compensation plan for all positions;\n(3) a reasonable period of probation during which a probationary employee may be discharged, demoted or transferred without benefit of hearing;\n(4) hours of work requirements and holiday, overtime and leave policies;\n(5) the evaluation of performance of employees for the purpose of improving staff effectiveness;\n(6) any reduction in force needed due to lack of funds or work, abolition of a position, material change in duties or reorganization;\n(7) promotions or transfers, which shall give appropriate consideration to the applicant's qualifications, skills, job performance and duties;\n(8) a disciplinary procedure, which shall provide for an equitable response to infractions of rules or work performance standards; and\n(9) an appeal process to review a disciplinary action solely involving suspension, demotion or termination.","path":["Chapter 36 - Attorneys","ARTICLE 1A District Attorney Personnel and Compensation"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18536/index.do","current_through":"2024-04-26","vintage":"","retrieved_at":"2026-09-03T15:02:19Z","sha256":"ff94882831e0db2c167cd14de84a38401f57bcac8e92975377257d49f4eef76a","source_id":"us-nm","stale":false,"prev":"us-nm/36-1a-7","next":"us-nm/36-1a-9"},"notice":"GroundRules: Original legal text.
