{"data":{"id":"us-nm/40-10a-202","jurisdiction":"us-nm","citation":"40-10A-202","heading":"Exclusive, continuing jurisdiction.","body":"(a) Except as otherwise provided in Section 204, a court of this state which has made a child-custody determination consistent with Section 201 or 203 has exclusive, continuing jurisdiction over the determination until:\n(1) a court of this state determines that the child, or the child and one parent, or the child and a person acting as a parent do not have a significant connection with this state and that substantial evidence is no longer available in this state concerning the child's care, protection, training and personal relationships; or\n(2) a court of this state or a court of another state determines that the child, the child's parents and any person acting as a parent do not presently reside in this state.\n(b) A court of this state which has made a child-custody determination and does not have exclusive, continuing jurisdiction under this section may modify that determination only if it has jurisdiction to make an initial determination under Section 201.","path":["Chapter 40 - Domestic Affairs","ARTICLE 10A Child Custody"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18540/index.do","current_through":"2026-07-01","vintage":"","retrieved_at":"2026-09-03T15:02:19Z","sha256":"0cd4e90aa3990b50678a3cf37ed582dd9a4ae89b4865e032fa90dced719c1190","source_id":"us-nm","stale":false,"prev":"us-nm/40-10a-201","next":"us-nm/40-10a-203"},"notice":"GroundRules: Original legal text.
