{"data":{"id":"us-nm/40-10c-6","jurisdiction":"us-nm","citation":"40-10C-6","heading":"Contents of petition.","body":"A petition pursuant to the Uniform Child Abduction Prevention Act shall be verified and include a copy of any existing child-custody determination, if available. The petition shall specify the risk factors for abduction, including the relevant factors described in Section 7 of the Uniform Child Abduction Prevention Act. Subject to the provisions of Subsection (e) of Section 40-10A-209 NMSA 1978, and if the information is reasonably ascertainable, the petition shall contain:\nA. the name, date of birth and gender of the child;\nB. the customary address and current physical location of the child;\nC. the identity, customary address and current physical location of the respondent;\nD. a statement of whether a prior action to prevent abduction or domestic violence has been filed by a party or other individual or entity having custody of the child and the date, location and disposition of the action;\nE. a statement of whether a party to the proceeding has been arrested for a crime related to domestic violence, stalking or child abuse or neglect and the date, location and disposition of the case;\nF. a statement of whether a party or other individual having custody of the child has sought the assistance of a domestic violence shelter and, if known, the approximate date and name of the person seeking the assistance of the shelter; and\nG. any other information required to be submitted to the court for a child-custody determination pursuant to Section 40-10A-209 NMSA 1978.","path":["Chapter 40 - Domestic Affairs","ARTICLE 10C Uniform Child Abduction Prevention"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18540/index.do","current_through":"2026-07-01","vintage":"","retrieved_at":"2026-09-03T15:02:19Z","sha256":"6ed37f5972bfa79e056e77dc2e38b0c8e92da57873d8e87ef517ab023a52ab93","source_id":"us-nm","stale":false,"prev":"us-nm/40-10c-5","next":"us-nm/40-10c-7"},"notice":"GroundRules: Original legal text.
