{"data":{"id":"us-nm/40-17-7","jurisdiction":"us-nm","citation":"40-17-7","heading":"Hearings on petition; grounds for issuance; contents of order.","body":"In determining whether grounds for any extreme risk firearm protection order exist, the court shall consider, at a minimum, the following:\nA. any recent act or threat of violence by the respondent against self or others, regardless of whether the act or threat involved a firearm;\nB. a pattern of acts or threats of violence by the respondent within the past twelve months, including acts or threats of violence against self or others;\nC. the respondent's mental health history;\nD. the respondent's abuse of controlled substances or alcohol;\nE. the respondent's previous violations of any court order;\nF. previous extreme risk firearm protection orders issued against the respondent;\nG. the respondent's criminal history, including arrests and convictions for violent felony offenses, violent misdemeanor offenses, crimes involving domestic violence or stalking;\nH. the respondent's history of the use, attempted use or threatened use of physical violence against another person; of stalking another person; or of cruelty to animals; and\nI. any recent acquisition or attempts at acquisition of a firearm by the respondent.","path":["Chapter 40 - Domestic Affairs","ARTICLE 17 Extreme Risk Firearm Protection Order"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18540/index.do","current_through":"2026-07-01","vintage":"","retrieved_at":"2026-09-03T15:02:19Z","sha256":"9b563a314188c71e2fcf292a93a50f1299b9ab75d5beeff6f8a533646a64aeb3","source_id":"us-nm","stale":false,"prev":"us-nm/40-17-6","next":"us-nm/40-17-8"},"notice":"GroundRules: Original legal text.
