{"data":{"id":"us-nm/42-14-2","jurisdiction":"us-nm","citation":"42-14-2","heading":"Definitions.","body":"As used in the Right to Repair Act:\nA. \"construction defect\" means a deficiency in the construction of a dwelling that is the result of a failure to exercise that degree of skill a reasonably prudent person skilled in such work would exercise in such circumstances;\nB. \"construction professional\" means a contractor or subcontractor performing the construction of a dwelling;\nC. \"dwelling\" means a newly constructed single family housing unit designed for residential use. \"Dwelling\" includes the systems and other components and improvements that are part of a single family housing unit at the time of construction;\nD. \"dwelling action\" means a complaint in court or the mechanism for dispute resolution in the construction contract between the purchaser and seller involving an alleged construction defect brought by a purchaser against the seller of a dwelling arising out of or related to the construction of the dwelling;\nE. \"purchaser\" means a person or entity who was the original purchaser or subsequent owner of a dwelling;\nF. \"reasonable detail\" includes all of the following:\n(1) an itemized list that describes each alleged construction defect; and\n(2) the street address of the dwelling where the alleged construction defect is observed and the location in the dwelling that is the subject of the notice; and\nG. \"seller\" means the party responsible for construction of the dwelling.","path":["Chapter 42 - Actions and Proceedings Relating to Property","ARTICLE 14 Right to Repair"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18542/index.do","current_through":"2024-04-27","vintage":"","retrieved_at":"2026-09-03T15:02:19Z","sha256":"feb82964623e4ee324635c1f99a42fe6d2b4606a10ccac23a5dd57396d9cab00","source_id":"us-nm","stale":false,"prev":"us-nm/42-14-1","next":"us-nm/42-14-3"},"notice":"GroundRules: Original legal text.
