{"data":{"id":"us-nm/44-7a-7","jurisdiction":"us-nm","citation":"44-7A-7","heading":"Validity of agreement to arbitrate.","body":"(a) An agreement contained in a record to submit to arbitration any existing or subsequent controversy arising between the parties to the agreement is valid, enforceable and irrevocable except upon a ground that exists at law or in equity for the revocation of a contract.\n(b) The court shall decide whether an agreement to arbitrate exists or a controversy is subject to an agreement to arbitrate.\n(c) An arbitrator shall decide whether a condition precedent to arbitrability has been fulfilled and whether a contract containing a valid agreement to arbitrate is enforceable.\n(d) If a party to a judicial proceeding challenges the existence of, or claims that a controversy is not subject to an agreement to arbitrate, the arbitration proceeding may continue pending final resolution of the issue by the court, unless the court otherwise orders.","path":["Chapter 44 - Miscellaneous Civil Law Matters","ARTICLE 7A Uniform Arbitration"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18545/index.do","current_through":"2023-06-16","vintage":"","retrieved_at":"2026-09-03T15:02:19Z","sha256":"4e7acd13247b3b757169816c560843ee3f239eb8599e10f3965ca43c65ddc31c","source_id":"us-nm","stale":false,"prev":"us-nm/44-7a-6","next":"us-nm/44-7a-8"},"notice":"GroundRules: Original legal text.
