{"data":{"id":"us-nm/46-11-310","jurisdiction":"us-nm","citation":"46-11-310","heading":"Disposition of unappointed property under released or unexercised general power.","body":"To the extent a powerholder releases or fails to exercise a general power of appointment other than a power to withdraw property from, revoke or amend a trust:\nA. the gift-in-default clause controls the disposition of the unappointed property; or\nB. if there is no gift-in-default clause or to the extent the clause is ineffective:\n(1) except as otherwise provided in Paragraph (2) of this subsection, the unappointed property passes to:\n(a) the powerholder if the powerholder is a permissible appointee and is living; or\n(b) if the powerholder is an impermissible appointee or deceased, the powerholder's estate if the estate is a permissible appointee; or\n(2) to the extent the powerholder released the power, or if there is no taker under Paragraph (1) of this subsection, the unappointed property passes under a reversionary interest to the donor or the donor's transferee or successor in interest.","path":["Chapter 46 - Fiduciaries and Trusts","ARTICLE 11 Uniform Powers of Appointment"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18547/index.do","current_through":"2024-04-26","vintage":"","retrieved_at":"2026-09-03T15:02:19Z","sha256":"c3ec342868b38159e25c4f8bbc01645df531a75807927b697f4062d6859d9cf3","source_id":"us-nm","stale":false,"prev":"us-nm/46-11-309","next":"us-nm/46-11-311"},"notice":"GroundRules: Original legal text.
