The Uniform Directed Trust Act applies to a trust, whenever created, that has its principal place of administration in New Mexico, subject to the following rules:\n(1) if the trust was created before January 1, 2019, that act applies only to a decision or action occurring on or after that date; and\n(2) if the principal place of administration of the trust is changed to New Mexico on or after January 1, 2019, that act applies only to a decision or action occurring on or after the date of the change.\nB. Without precluding other means to establish a sufficient connection with the designated jurisdiction in a directed trust, the terms of the trust that designate the principal place of administration of the trust are valid and controlling if:\n(1) a trustee's principal place of business is located in, or a trustee is a resident of, the designated jurisdiction;\n(2) a trust director's principal place of business is located in, or a trust director is a resident of, the designated jurisdiction; or\n(3) all or part of the administration occurs in the designated jurisdiction.","path":["Chapter 46 - Fiduciaries and Trusts","ARTICLE 14 Uniform Directed Trust"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18547/index.do","current_through":"2024-04-26","vintage":"","retrieved_at":"2026-09-03T15:02:19Z","sha256":"845c55e31d21a6e4a8e0ab9d95e4beb5c9cf60281ad185eade4f68a6e07d5dd6","source_id":"us-nm","stale":false,"prev":"us-nm/46-14-2","next":"us-nm/46-14-4"},"notice":"GroundRules: Original legal text.
