{"data":{"id":"us-nm/57-28-2","jurisdiction":"us-nm","citation":"57-28-2","heading":"Definitions","body":"As used in the Prompt Payment Act:\nA. \"construction\" means building, altering, repairing, installing or demolishing in the ordinary course of business any:\n(1) road, highway, bridge, parking area or related project;\n(2) building, stadium or other structure;\n(3) airport, subway or similar facility;\n(4) park, trail, athletic field, golf course or similar facility;\n(5) dam, reservoir, canal, ditch or similar facility;\n(6) sewage or water treatment facility, power generating plant, pump station, natural gas compression station or similar facility;\n(7) sewage, water, gas or other pipeline;\n(8) transmission line;\n(9) radio, television or other tower;\n(10) water, oil or other storage tank;\n(11) shaft, tunnel or other mining appurtenance;\n(12) electrical wiring, plumbing or plumbing fixture, gas piping, gas appliances or water conditions;\n(13) air conditioning conduit, heating or other similar mechanical work;\n(14) leveling or clearing land;\n(15) excavating earth;\n(16) drilling wells of any type, including seismographic shot holes or core drilling; and\n(17) similar work, structures or installations;\nB. \"contractor\" means a person performing construction through a contract with an owner;\nC. \"owner\" means a person, local public body or state agency other than the department of transportation;\nD. \"person\" means an individual, corporation, business trust, estate, trust, partnership, limited liability company, association, joint venture or similar legal entity; and\nE. \"subcontractor\" means a person performing construction for the owner not through a contract with the owner.","path":["Chapter 57 - Trade Practices and Regulations","ARTICLE 28 Retainage"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18560/index.do","current_through":"2025-06-20","vintage":"","retrieved_at":"2026-09-03T15:02:20Z","sha256":"ef33ee872765fabd4378580a79064a4ad672a6095ef285eaa5ae09040f45e706","source_id":"us-nm","stale":false,"prev":"us-nm/57-28-1","next":"us-nm/57-28-3"},"notice":"GroundRules: Original legal text.
