{"data":{"id":"us-nm/58-13a-4","jurisdiction":"us-nm","citation":"58-13A-4","heading":"Exempt persons.","body":"The prohibition in Subsection B of Section 3 [58-13A-3 NMSA 1978] of the Model State Commodity Code shall not apply to any of the following persons, or any employee, officer or director thereof acting solely in that capacity:\nA. a person registered with the commodity futures trading commission as a futures commission merchant or as a leverage transaction merchant whose activities require such registration;\nB. a person registered with the securities and exchange commission as a broker-dealer whose activities require such registration;\nC. a person affiliated with, and whose obligations and liabilities are guaranteed by, a person referred to in Subsection A or B of this section;\nD. a person who is a member of a contract market designated by the commodity futures trading commission or any clearinghouse thereof;\nE. a financial institution; or\nF. a person registered under the laws of this state as a securities broker-dealer whose activities require such registration.","path":["Chapter 58 - Financial Institutions and Regulations","ARTICLE 13A Model State Commodity Code"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18561/index.do","current_through":"2025-01-07","vintage":"","retrieved_at":"2026-09-03T15:02:20Z","sha256":"ddac7be1d77985f397d93d6500647ff09b9a77378f0b55b896fa92e0a8e860b5","source_id":"us-nm","stale":false,"prev":"us-nm/58-13a-3","next":"us-nm/58-13a-5"},"notice":"GroundRules: Original legal text.
