The state income tax form shall allow a taxpayer to:\n(1) identify whether the taxpayer or members of the taxpayer's household are uninsured;\n(2) provide the taxpayer's consent to provide to the department and the exchange:\n(a) the taxpayer's insurance-relevant information; and\n(b) information on any consent provided by the taxpayer pursuant to this subsection;\n(3) provide the taxpayer's consent to enroll:\n(a) the taxpayer in medicaid; or\n(b) members of the taxpayer's household in medicaid if: 1) coverage by medicaid is available to those household members; and 2) the taxpayer has legal authority to consent to enroll those household members; and\n(4) provide information on any consent provided by the taxpayer pursuant to this subsection.\nB. The taxation and revenue department shall forward to the department:\n(1) the taxpayer's insurance-relevant information if, on the taxpayer's state income tax form, the taxpayer elects to provide the taxpayer's insurance-relevant information to the department and the exchange pursuant to Subsection A of this section; and\n(2) information on any consent by a taxpayer provided pursuant to this section if the taxpayer agrees to provide information on that consent to the department and the exchange in accordance with this section.","path":["Chapter 59A - Insurance Code","ARTICLE 23H Easy Enrollment"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18562/index.do","current_through":"2026-07-01","vintage":"","retrieved_at":"2026-09-03T15:02:20Z","sha256":"3787c4df5abd373009243122056f6a1bf4352de2db5d0082af537b8307a9763e","source_id":"us-nm","stale":false,"prev":"us-nm/59a-23h-3","next":"us-nm/59a-23h-5"},"notice":"GroundRules: Original legal text.
