{"data":{"id":"us-nm/60-13b-2","jurisdiction":"us-nm","citation":"60-13B-2","heading":"Definitions.","body":"As used in the Elevator Safety Act:\nA. \"apprentice\" means an individual who is learning a trade from a licensed employer and participates in a registered apprenticeship program;\nB. \"certificate of operation\" means a document issued by the division that indicates the conveyance has passed the required safety inspection and tests and fees have been paid as set forth in the Elevator Safety Act;\nC. \"contractor\" means a person that:\n(1) is engaged in the trade of erecting, constructing, installing, altering, servicing, testing, repairing, maintaining, removing or dismantling conveyances contained within a building or structure;\n(2) is properly licensed as a contractor by the division pursuant to the Elevator Safety Act; and\n(3) employs mechanics and apprentices pursuant to the Elevator Safety Act;\nD. \"conveyance\" means:\n(1) a hoisting and lowering mechanism equipped with a car or platform that moves between two or more landings, including elevators, escalators, moving sidewalks, platform lifts or stairway chair lifts for carrying persons between landings; and\n(2) a hoisting and lowering mechanism that is equipped with a car, that serves two or more landings and that is restricted to carrying materials by its limited size and limited access;\nE. \"director\" means the director of the division;\nF. \"division\" means the construction industries division of the regulation and licensing department;\nG. \"inspector\" means a person certified by the division in the trade of elevator safety to conduct inspections and ensure that work performed by a contractor complies with applicable standards and codes and is employed by the division or a county, municipality or other political subdivision;\nH. \"mechanic\" means an individual who:\n(1) possesses a journeyman elevator mechanic's certificate pursuant to the provisions of the Elevator Safety Act; and\n(2) is engaged in erecting, constructing, installing, altering, servicing, testing, repairing, maintaining, removing or dismantling conveyances covered by the Elevator Safety Act;\nI. \"standards\" means national standards developed for the installation, use or maintenance of conveyances and adopted by division rule; and\nJ. \"temporarily dormant\" means a conveyance that is placed out of service as specified in the Elevator Safety Act.","path":["Chapter 60 - Business Licenses","ARTICLE 13B Elevator Safety"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18563/index.do","current_through":"2026-07-01","vintage":"","retrieved_at":"2026-09-03T15:02:20Z","sha256":"621548fcde435c4a293c87a76c2fc2480651847fdbae90456db72e325666f2f7","source_id":"us-nm","stale":false,"prev":"us-nm/60-13b-1","next":"us-nm/60-13b-3"},"notice":"GroundRules: Original legal text.
