A physician, nurse, technician, phlebotomist or technologist who withdraws blood from a person in the performance of a chemical blood test that has been directed by a law enforcement officer, or by a judicial or probation officer, shall not be held liable in a civil or criminal action for assault, battery, false imprisonment or any conduct of a law enforcement officer, except for negligence, nor shall a person assisting in the performance of the test, or a hospital wherein blood is withdrawn in the performance of the test, be subject to civil or criminal liability for assault, battery, false imprisonment or any conduct of a law enforcement officer, except for negligence.","path":["Chapter 66 - Motor Vehicles","ARTICLE 13 Boating While Intoxicated"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18569/index.do","current_through":"2026-07-01","vintage":"","retrieved_at":"2026-09-03T15:02:20Z","sha256":"4dcef93c5eb565e6bb26d28ef277c6d51cf2c6d017297894b0fe310791427833","source_id":"us-nm","stale":false,"prev":"us-nm/66-13-5","next":"us-nm/66-13-7"},"notice":"GroundRules: Original legal text.
