{"data":{"id":"us-nm/66-8-103","jurisdiction":"us-nm","citation":"66-8-103","heading":"Chemical blood tests; persons qualified to perform tests; relief from liability.","body":"Only a physician, licensed professional or practical nurse, emergency medical technician or certified phlebotomist or a technologist employed by a hospital or physician shall withdraw blood from a person in the performance of a chemical blood test. No such physician, nurse, technician, phlebotomist or technologist who withdraws blood from a person in the performance of a chemical blood test that has been directed by a police officer or by a judicial or probation officer shall be held liable in any civil or criminal action for assault, battery, false imprisonment or any conduct of a police officer except for negligence, nor shall a person assisting in the performance of the test or a hospital wherein blood is withdrawn in the performance of the test be subject to civil or criminal liability for assault, battery, false imprisonment or any conduct of a police officer except for negligence.","path":["Chapter 66 - Motor Vehicles","ARTICLE 8 Crimes, Penalties and Procedure"],"source_url":"https://nmonesource.com/nmos/nmsa-unanno/en/item/18569/index.do","current_through":"2026-07-01","vintage":"","retrieved_at":"2026-09-03T15:02:20Z","sha256":"5c5d49f2f5b8a487247cfa03a3237ad6c8bb088b21d5e066d022cfa51b73428a","source_id":"us-nm","stale":false,"prev":"us-nm/66-8-102.5","next":"us-nm/66-8-104"},"notice":"GroundRules: Original legal text.
